These terms and conditions are current as at 1 January 2015.
This website comprises all domains, sub-domains and parked domains affiliated with www.australiabiznet.com.au.
This website primarily contains advertisements requested or arranged by third parties.
On occasions, some websites may be created by Australiabiznet to demonstrate its service. Businesses advertised in this way will not need to pay for the advertisements for which they have not subscribed. These businesses should note that unless the advertisements are subscribed the advertisements may disappear without notice.
While basic checks will be undertaken, we do not thoroughly investigate the information that is provided to us for recording on a website.
Australiabiznet makes no representations about the accuracy or suitability of the information, or links provided on this website, or on websites that link to this website.
Australiabiznet will have sole discretion on the acceptance of advertisements, the placement and positioning of advertisements, the decision on whether or not to show advertisements, and the information which is disclosed in an advertisement.
The information that may be displayed will be limited to: Business name; Business address, business phone number, business email, business website, business logo, photograph of business owner, and description of business as well as documents, audio, video or other media supplied by advertisers. No other information will be disclosed or held on any electronic media accessible through the website for privacy reasons.
Readers are encouraged to validate and verify information shown about an advertiser from other third party sources.
Any person who accesses the information and links on this website does so at their own risk.
To Become an Advertiser on Australabiznet
You are to fully complete an application form with either 1 or 3 other colleagues from different business entities and satisfy any of the criteria listed 1 to 6:
- Separate and different businesses located in very close proximity to each other.For example: in a block of shops or offices or in a recognised shopping precinct.
Ideally, the same street address applies – for example: shop1 25 High Street, shop 2 25 High street, shop 5, 25 High Street, etc.. in the same town and postcode]
- The same type of business in the same town or suburb, and postcode.For example: Accountants in Largeville NSW 2xxx;
- The same specialisation in the same town or suburb postcode.For example: Men’s Footwear, Largeville NSW 2xxx;
- Complimentary services from different businesses in the same town and postcode.For example: Mechanic; Tyre retailer; Auto Electrician, Car Detailing; Smash Repairs; Car Sales.
- Branches of the same business in the same town and postcode.
- Not for Profit Social Clubs, Sporting Groups, who are advertising to attract members.
Australiabiznet will accept from an advertiser multiple advertising requests in these categories. For example: if a business considers it specialises in two or more distinct fields then Australiabiznet will be willing to provide two or more specialised webpages.
Each website page will have no more than four Standard Advertising businesses [unless banner advertising applies]. While we prefer to have two businesses or four businesses advertising on the same webpage we will accept requests for a single business webpage where your business is genuinely unique and has no direct competition.
Australiabiznet editorial staff will not permit sites to adopt general locations where it is more appropriate to narrow the description. For example, “Accountants Sydney” is unlikely to be acceptable as Sydney is considered a broad general location and is a centre with numerous people providing the same service. Instead “Accountants Bondi” or “Accountants Manly” is more likely to be permitted. It is the advertiser’s responsibility to ensure this requirement is met before lodging your request to place an advertisement.
Each advertiser is to have an Australian Business Number although they do not need to be registered for GST.
Individuals from the same business operation are not to take separate advertisements on the same page. Each advertisement on a single page is to be from a different business – unless the advertiser is following the branch format in which case all advertisements are to be from the same business in the same business name.
Australiabiznet will consider requests for banner advertising on the following basis:
- The advertiser is to nominate the page[s] on which they wish to advertise.
- The advertising must relate to the topic of the page.
- The banner advertiser is not one of the 4 Standard advertisers.
- The banner advertiser must be in a complementary business to the advertisers on the site.
- The banner advertiser is to have an active office in the same local geographical area as the advertisers;
- The banner advertising request is to be in writing and is to include full details of the proposal.
- The banner advertiser is to provide the banner advertisement;
- The banner advertising must be acceptable to editorial staff;
- The cost of banner advertising will be payable on a monthly basis.
Where banner advertising is not taken Australiabiznet may use the banner advertising page location in the manner it chooses.
Obtaining Email Addresses of Visitors to Your Site
Australiabiznet will request the email address of visitors to our sites.
This information can be used at your request to notify visitors of important information regarding your business. Examples include: change of location; issuing reminders of key dates eg service dates, checkups, compulsory activities, etc; notifying about specials or sales; etc.
Advertisers are not to request email distributions too frequently or request emails that could constitute spam.
The general approach adopted by Australiabiznet is to not distribute requested emails more frequently than each 90 days.
Any email addresses obtained in this process will remain the property of Australiabiznet. The email addresses will not be sold while Australiabiznet is under current ownership.
Users of advertising services will recognise the charges to be levied are heavily discounted to charges levied by other advertising providers.
Australiabiznet is discounting the price to encourage advertisers to use their relationships to obtain and arrange suitable groups of advertisers for placement on multiple website pages.
It is feasible that each business could arrange 4 or 5 different pages which contain their own ads. As stated these could be based on:
1] same basic address;
2] same type of business in the same suburb or if there are insufficient people in the same business in the same suburb then in the same area;
3]same business specialisation in the same suburb or area;
4] same business interest ( eg property sales and includes real estate agent, conveyancer, solicitor, mortgage broker, insurance broker, accountant); or
5] same business name in close locations.
The charges currently applying for advertising on this website are:
Standard fee for standard webpage advertising is currently $20 per month per advertisement per advertiser.
To clarify if 4 businesses are advertising on a page then the fee will be $80 per month or $960 per year. Each advertiser is to pay their portion separately. The liability for each business is $240 per annum.
The charge is payable one month in advance.
Discounts to our standard fee will be applied in the following circumstances:
1] a 50% discount will apply for a period of 6 months if at least 2 webpages each with 4 businesses is requested and is established by Australiabiznet. At the end of 6 months the standard fee will apply.
2] a 10% discount will apply for a period of 6 months if at least 2 webpages each with 2 businesses is requested and is established by Australiabiznet. At the end of 6 months the standard fee will apply.
Special discounts may also be offered periodically.
3]The monthly fee may be reviewed at any time and may be changed after giving 3 months notice. Notice represents recording the change on this website.
4] For Not for Profit Social Clubs and Sporting Groups only the price will be $5 per month per club per advertisement. This means the cost for a single page across 4 clubs will be $20 per month.
To have one page the clubs must be of the same type, for example: all tennis clubs; all cricket clubs, all darts clubs; all speaking clubs; all card playing clubs; etc..
The four clubs should be in the same town or suburb, where this is not possible, Australiabiznet will allow four clubs from the same region for Not for Profit Social Clubs and Sporting Groups only.
The advertising rate for banner advertising will be $100 per month.
The minimum price for banner advertising will always exceed the price for standard advertising.
Where an advertiser requests email distributions to be undertaken the cost will be a flat fee of $100 irrespective of the number of people who will receive emails.
Fees for changes to advertisements, adding / removing audio, video or documents, changing links for “landing pages” showing your weekly / monthly specials will be $30 per change.
Australiabiznet is unable to confirm future prices beyond those shown. We do anticipate prices will change as our business needs change.
As Australiabiznet becomes more widely accepted, differential pricing based on geographical areas may be introduced to reflect demand.
Australiabiznet will be monitoring visitor movements on each website and may in future determine fees based on visitor behavior.
Non Payment of Advertising Charges
In the event of non payment of advertising charges Australiabiznet reserves the right to:
A] immediately discontinue all advertising for any advertiser or all advertisers on the same page;
B] notify credit reporting agencies of default;
C] disclose full details of account performance, if requested, for the purposes of trade or credit references on clients behalf.
D] notify advertisers, who are advertising on the same page, of one or more advertisers who have failed to pay advertising charges. Australiabiznet may also disclose the total amount owing under these circumstances.
Australiabiznet may, however, choose to continue advertising even if non payment has occurred. The decision on whether to continue advertising will be at the sole discretion of Australiabiznet.
We take all reasonable care in compiling this website however we do not warrant or represent that it is complete, current or free from errors or omissions. We accept information on this site in good faith from advertisers and we advise all purchasers to undertake their own research to determine the suitability of any goods or services acquired.
We also strongly encourage all internet users to utilise the highest standard of antivirus, anti-spam, anti-spyware software available and which a prudent person would consider appropriate. We also encourage all users to use firewall protection.
No Representations or Warranties
In relation to the businesses listed on this site. We make no representations, in whatever form, as to:
- a) The accuracy of the information provided by advertisers,
- b) the type of business operated by advertisers,
- c) the quality of the business owned by advertisers,
- d) the quality and standard of any products or services the advertisers may provide;
- e) the financial strength of each of the advertisers;
- f) the personal honesty, integrity, reliability, expertise or acumen of the principals of any advertiser.
We also make no representations as to:
- a) the reliability of the website;
- b) the times at which the website will be available;
- c) the reliability of the providers of services to Australiabiznet;
- d) the level of exposure of the site or page on which subscribers have advertised;
- e) the level of additional clients a business may attract by advertising using Australiabiznet;
- f) the advertising model adopted by Australiabiznet being the best model for an advertiser;
- g) The absence of programming errors or computer viruses on this web site, in its contents, or on websites that are linked, in anyway, to this website.
When we are not liable
We are not liable for:
1] any loss to the extent it is caused by you;
2] any loss that results from your failure to take reasonable steps to avoid or minimise your loss;
3] any loss that arises through events outside our reasonable control.
4] any information placed on our site by advertisers where the advertisers have warranted they have the rights to authorise or provide the information shown and that the information provided is accurate, complete and not misrepresenting their offer; and
5] not using information that is submitted and which we decide is unsuitable for promotion;
6] any losses arising from typographical errors or other errors;
7] any losses incurred because the services provided by a business differed to the services advertised;
8] any losses incurred or damage caused by programming errors or computer viruses on this website or on any other website linked to any part of Australiabiznet.
Where any statute implies any term into your use of or any arrangement arising out of the accessing of this web site and that statute prohibits exclusion of that term, then that term is included in these terms and conditions.
Liability and Indemnity
Advertisers and or advertising agencies indemnify Australiabiznet and its directors, trustees, beneficiaries, employees and contractors against any claims arising from:
- defamation, libel, slander of title;
- infringement of copyright;
- infringement of trademarks or names of publication titles;
- unfair competition;
- misrepresentation about products and services;
- breach of trade practices, privacy or fair trading legislation;
- violation of rights of privacy or confidential information or licences or royalty rights or other intellectual property rights;
- any loss or damage including indirect or consequential loss or damage regardless of its cause (including negligence and tort) arising out of or in any way connected with the supply of or failure to supply the advertising service, a payment method in an agreement, and/or any inaccuracy, inadequacy or incompleteness of information contained on this Website or any affiliated websites; and
- An Advertiser assigning its rights or obligations under any agreement express or implied with Australiabiznet.
Misdemeanours and Nuisance
You are not to:
- tamper with, hinder the operation of or make any modifications to this website or any affiliated websites;
- knowingly transmit any virus, worm, Trojan horse or other disabling feature to this website or any affiliated websites;
- use this Site to send commercial, unsolicited or bulk electronic messages to anyone or in any other way which would constitute an infringement of the Spam Act 2003 (Cth);
- Use this site for any illegal operations, activities, or intentions.

It is unknown what information the technology used by the third parties is able to identify. It is for this reason individual login by advertisers and sensitive information will not be available on this website.
We are unable to control covert assessment and analysis of our websites by other providers, hosting entities, domain registries or unknown third parties. We recommend advertisers and users use constantly updated antivirus and personal firewall software to minimise the risk of loss of data.

You may click-through to the third party sites from our sites. Should you choose to click-through we recommend you refer to the privacy statement on the sites you visit. We will not be responsible for the information collected about you, by you accessing third party websites.

Applications developed by Australiabiznet have been prepared in good faith and prepared without ever seeing, being told about, or having any information about similar applications in the same field. Consequently, any similarity between Australiabiznet applications and other applications is coincidental and is unintended.
